TERMS OF SERVICE

Welcome to Pawpaw! These Terms of Service ("Terms") govern your access to and use of the products and services (collectively, the "Services") provided by Pawpaw and its affiliates ("Pawpaw," "us," or "we"). Please read these Terms carefully before using our Services.

By downloading, installing, accessing, or using Pawpaw, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Pawpaw, a Canadian company.

IF YOU DO NOT AGREE TO THESE TERMS OR DO NOT HAVE THE LEGAL CAPACITY TO ENTER INTO THIS AGREEMENT, YOU MUST NOT ACCESS OR USE THE SERVICES.

1. Eligibility.

You must be at least 13 years of age to use Pawpaw. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Services, you represent and warrant that you meet these eligibility requirements.

2. Account Registration and Security.

To access certain features of the Services, you must create an account using Google Sign-In, Apple ID, or other authentication methods we provide. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account information updated
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account

You must notify us immediately at support@pawpawhub.app if you suspect any unauthorized access to your account.

YOU ARE RESPONSIBLE FOR ALL ACTIVITY ON YOUR ACCOUNT. PAWPAW IS NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO PROTECT YOUR ACCOUNT CREDENTIALS.

3. Description of Services.

Pawpaw provides a mobile application offering:

  • AI-powered pet care advice and guidance
  • A lost pet alert and recovery system
  • Community features including social feed and direct messaging
  • Pet-friendly park discovery and reviews
  • A credit-based system (PawCredits) for premium features

The Services are provided "as-is" and are subject to change, modification, or discontinuation at any time without prior notice.

4. AI Disclaimer and Medical Warning.

IMPORTANT: THE AI PET ASSISTANT IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

Pawpaw's AI Care Guide offers general pet care information and guidance based on publicly available veterinary knowledge. It DOES NOT provide medical, veterinary, or professional advice. The AI cannot diagnose illnesses, prescribe medications, or replace the expertise of a licensed veterinarian.

IN CASE OF A MEDICAL EMERGENCY OR ANY CONCERN ABOUT YOUR PET'S HEALTH, YOU MUST CONSULT A LICENSED VETERINARIAN IMMEDIATELY. RELIANCE ON AI-GENERATED CONTENT IS AT YOUR OWN RISK.

Pawpaw, its affiliates, officers, directors, employees, and agents shall not be held liable for any harm, injury, death, or damages resulting from reliance on AI-generated advice or any content provided through the Services.

5. PawCredits and Premium Features.

Pawpaw operates on a credit-based system called "PawCredits" for accessing premium AI features:

  • Free Credits: New users receive free credits upon registration
  • Earning Credits: Additional credits can be earned through referrals, community engagement, and promotional activities
  • Purchasing Credits: Credits can be purchased through in-app purchases via Google Play or Apple App Store
  • Usage: Credits are consumed when using premium AI features such as the Food Safety Scanner, Visual Wellness Insight, and Meal Planning

Important: PawCredits are non-transferable, have no cash value, and cannot be exchanged for currency. Unused credits do not expire unless your account is terminated. Pawpaw reserves the right to modify credit values, earning rates, and consumption rates at any time.

6. Subscriptions.

Some features may be offered through subscription plans. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through your device's app store settings. Refunds are subject to the policies of Google Play or Apple App Store.

7. User Content and License.

You retain ownership of all content you create, upload, or share through the Services ("User Content"), including photos, videos, posts, comments, and messages.

By submitting User Content, you grant Pawpaw a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating and improving the Services.

You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to your User Content and that your content does not violate any third-party rights, including intellectual property, privacy, or publicity rights.

8. Community Guidelines and Prohibited Conduct.

By using Pawpaw, you agree to abide by our Community Guidelines. You agree NOT to:

  • Harass, bully, threaten, or intimidate other users
  • Post content that is hateful, discriminatory, violent, or sexually explicit
  • Share false, misleading, or fraudulent information, including false lost pet reports
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in spamming, phishing, or distributing malware
  • Attempt to circumvent security features, reverse engineer the app, or access unauthorized areas
  • Use the Services for commercial purposes without our written consent
  • Violate any applicable laws or regulations

Pawpaw reserves the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

9. Lost Pet Feature.

The lost pet alert system relies on community participation and location data. By using this feature:

  • You consent to sharing your approximate location with nearby users to facilitate pet recovery
  • You agree to provide accurate information when reporting lost pets and sightings
  • You understand that Pawpaw is not responsible for the accuracy of user-submitted reports or the outcome of any pet recovery efforts

YOUR PRIVACY IS PROTECTED: When using location-based features, only your approximate area is shared (neighborhood, street name, city) — never your exact address. For example, if you are at "1234 Rue Sainte-Catherine, H2X 1K4", other users will only see "Rue Sainte-Catherine, Montreal, Canada". This ensures you can help locate lost pets while keeping your precise location private.

FALSE LOST PET REPORTS ARE A VIOLATION OF THESE TERMS AND MAY RESULT IN IMMEDIATE ACCOUNT TERMINATION.

10. Intellectual Property.

The Pawpaw name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pawpaw or its affiliates. All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of Pawpaw and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services or included software without our express written permission.

11. Third-Party Services.

The Services may integrate with or contain links to third-party services, including Google Maps, authentication providers, payment processors, and AI services. These third-party services are governed by their own terms and privacy policies. Pawpaw is not responsible for the content, privacy practices, or availability of third-party services.

12. Disclaimer of Warranties.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PAWPAW DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

13. Limitation of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAWPAW AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

IN NO EVENT SHALL PAWPAW'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO PAWPAW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER.

14. Indemnification.

You agree to indemnify, defend, and hold harmless Pawpaw and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another

15. Termination.

By You: You may terminate your account at any time by using the "Delete Account" feature in the App settings. Upon termination, your User Content may be deleted, although some information may be retained as required by law or for legitimate business purposes.

By Us: We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Reasons for termination include, but are not limited to, violation of these Terms, suspected fraudulent or illegal activity, or prolonged inactivity.

Effect: Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the Services.

16. Governing Law and Dispute Resolution.

These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Quebec, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts located in Montreal, Quebec, Canada, and you consent to the personal jurisdiction of such courts.

17. Changes to Terms.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new terms, you must stop using the Services.

18. Severability.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

19. Entire Agreement.

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Pawpaw concerning your use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
